A termination without notice is an extraordinary form of contract termination that may be issued by THE FIZZ if there are serious breaches of the tenancy agreement or house rules.
Common causes include:
- Significant rent arrears: Failing to pay your monthly all-in rent over multiple months or accumulating major debt.
- Repeated misconduct: Continuing to breach the house rules (e.g. severe noise issues or continuous disruptions) after already receiving a formal written warning.
- Severe violations: Vandalism, intentional property damage, or threatening staff members and fellow residents.
Important Legal and Financial Consequences
⚠️ Payment obligations do not automatically stop: Even though you may be required to vacate the building immediately, a termination without notice does not automatically release you from your financial obligations. You may remain liable for rent payments until a replacement tenant is found or your contract's standard minimum term expires.
Resolving payment-related terminations: If the termination was issued due to unpaid rent, it may be withdrawn if the entire outstanding balance is settled within the specified deadline. However, this option is generally only available once.
Eviction proceedings & SCHUFA: If you do not vacate the apartment and return your keys by the required date, legal action may be initiated. Any resulting court and legal costs may be charged to you. In addition, this may lead to a negative SCHUFA entry, which can make it more difficult to rent accommodation in the future.
