A termination without notice (fristlose Kündigung) is the most severe legal action taken when agreement rules are broken. It is issued when a tenant's behavior makes it impossible for THE FIZZ to reasonably continue the lease. Common causes include:
Significant Rent Arrears: Failing to pay your monthly all-in rent over multiple months or accumulating major debt.
Repeated Misconduct: Continuing to breach the house rules (e.g., severe noise issues, continuous disruptions) after already receiving a formal written warning notice.
Severe Violations: Vandalism, intentional property damage, or threatening staff and fellow residents.
Crucial Legal and Financial Consequences
Payment obligations do not automatically stop: Even though you are required to vacate the building immediately, a termination without notice does not automatically free you from your financial duties. You may legally remain liable for the monthly rent payments until a replacement tenant is found or your agreement's standard minimum term expires.
Resolving payment-related terminations: If the termination was issued strictly due to unpaid rent, it can sometimes be reversed if you clear the entire outstanding balance within the specified emergency deadline. However, this safety net is generally only available once.
Eviction Lawsuits & Credit Score: If you do not pack up and return your keys on the required date, our legal team will initiate formal eviction proceedings. The heavy court and legal fees will be charged entirely to you. Furthermore, this leads to a negative impact on your credit rating (such as KSV1870 in Austria), making it extremely difficult to rent a home in the future.
